EPA is closing in on changes to Clean Air Act regulations for some solid waste incinerators, following a lawsuit brought almost a decade ago.
The agency on Tuesday sent a draft final rule for small and institutional trash-burning operations to the White House regulations office for a routine review, according to a notice posted on a government tracking website.
Under a revised settlement to the Sierra Club suit filed in 2016 in the U.S. District Court for the District of Columbia, EPA must wrap up work on the rule by the end of next month.
The draft, which has not yet been made public, is notable as only the third regulation of any kind that EPA has sent to the Office of Management and Budget regulations office in the 3 ½ months since President Donald Trump took office. The first two, which are still under review, would repeal existing regulations, according to EPA’s thumbnail descriptions of each.
